The present general terms and conditions of sale (hereinafter “GTC”) govern the contractual relations between any user of the website www.legendsmagazine.ch (hereinafter “the Client”) and Legends Magazine (hereinafter “the Seller”). By accessing our site and placing an order, you accept without reservation these GTC.
1. Purpose
The purpose of these GTC is to define the rights and obligations of the parties in the context of the online sale of products and services offered by the Seller on the Site.
2. Products and Services
Legends Magazine offers subscriptions to its magazine as well as the sale of individual issues. The essential characteristics of the products and services are presented on the Site.
3. Order
- Order process: To place an order, the Client must select the desired product or service, add it to their cart, and follow the instructions to finalize the purchase. The Client must provide accurate and complete information.
- Order confirmation: Once the order is placed, the Client will receive a confirmation email summarizing the order details.
4. Price
- Pricing: The prices of products and services are indicated in Swiss francs (CHF), all taxes included (TTC).
- Price changes: The Seller reserves the right to modify prices at any time, but products will be billed based on the rates in effect at the time of order validation.
5. Payment
- Payment methods: The Client can pay for their order by credit card via Stripe, PayPal, or any other payment method offered on the Site.
- Payment security: Transactions are secured by an encryption protocol. The Seller does not have access to the Client’s payment data.
- Direct debit and automatic renewal: For subscriptions, payment is made by direct debit on the Client’s credit card via Stripe. The subscription is automatically renewed each period (monthly or annually) until canceled by the Client.
6. Delivery
- Delivery time: Physical products are delivered to the address indicated by the Client when placing the order. The delivery time is indicated at the time of order and varies depending on the destination.
- Delivery fees: Delivery fees are calculated based on the weight of the products and the destination. They are indicated to the Client before order validation.
- Delivery issues: In case of delivery delay or damaged products, the Client must contact customer service as soon as possible.
7. Cancellation and Termination
- Right of withdrawal: The Client has a period of 14 days from the receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties.
- Subscription cancellation: The Client can cancel their subscription at any time via their account on the Site or by contacting customer service. The cancellation will take effect at the end of the current subscription period.
8. Liability
The Seller cannot be held liable for non-performance of the contract in the event of force majeure, total or partial disruption or strike, notably of postal services and means of transport and/or communications.
9. Personal Data Protection
The Client’s personal data is processed in accordance with our Privacy Policy. By using the Site, the Client consents to this use of their data.
10. Intellectual Property
All elements of the Site are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the Site whether they are software, visual, or audio.
11. Applicable Law and Disputes
These GTC are subject to Swiss law. In case of dispute, an amicable solution will be sought before any legal action. Failing that, Swiss courts will have jurisdiction to settle the dispute.
